Telangana High Court says motorists cannot be forced to pay pending challans

Hyderabad: The Telangana High Court on Tuesday made clear observations on the recovery of pending traffic challans. It ruled that enforcement staff cannot force motorists to pay fines on the spot. It also barred coercive practices during vehicle checks.

The court said traffic police must not seize bike keys. It also said officers must not compel motorists to clear old challans during inspections. Instead, police may collect fines only when motorists agree to pay voluntarily.

Further, the court said authorities must follow due process if motorists refuse immediate payment. In such cases, officials should issue notices rather than apply pressure.

The court stressed the need to respect motorists’ rights. It said enforcement agencies must implement traffic laws within legal limits. Therefore, officials must recover pending challans strictly as per law and not through intimidation.

Meanwhile, the court took note of complaints from motorists. Many had reported pressure to clear old challans during routine checks. As a result, the court’s directions aim to bring clarity to enforcement practices. They also seek uniform handling of challans across Telangana.
